Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of PropertyPixel ("Service"), operated by Web Ninja - FZCO, a company registered in the Dubai Silicon Oasis Free Zone, Dubai, United Arab Emirates ("Company," "we," "our," or "us").

By creating an account or using the Service, you confirm that you are at least 18 years old and agree to be bound by these Terms. If you do not agree, you may not access the Service.

2. Description of Service

PropertyPixel provides AI-powered photo enhancement services for real estate agents, property photographers, marketing agencies, and property professionals. The Service allows you to upload property photos and apply enhancements including decluttering, lighting correction, sky replacement, furniture removal, virtual staging, video generation, and 3D virtual tour creation.

3. Account Registration

To use our Service, you must:

• Create an account with a valid email address
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years of age

You are responsible for all activities that occur under your account. Notify us immediately at hello@propertypixel.app if you suspect unauthorized access.

4. Subscription and Payments

Free Trial: New accounts receive 500 free credits (enough for 5 standard photo enhancements). Trial credits expire 30 days after account creation. Trial-enhanced images include a small watermark; subscribe to any paid plan to receive clean, watermark-free downloads.

Paid Plans: Subscription fees are billed in advance on a monthly or annual basis in USD via Stripe. Prices are displayed on our Pricing page and may be updated with at least 30 days' notice to existing subscribers.

Credit Top-ups: Additional credit packs may be purchased at any time. Top-up credits do not expire for 12 months from the date of purchase and roll over if unused.

Monthly Subscription Credits: Credits included in a subscription plan reset each billing cycle and do not roll over to the next period.

Cancellation: You may cancel your subscription at any time from the Billing settings page. Access continues until the end of your current billing period. We do not provide refunds for partial billing periods or unused subscription credits. If you believe you have been charged in error, contact us within 14 days and we will investigate.

Taxes: Prices are exclusive of any applicable taxes. You are responsible for any taxes or duties applicable in your jurisdiction.

5. Acceptable Use

You agree not to:

• Upload images you do not own or have the right to use
• Upload illegal, offensive, defamatory, or inappropriate content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any unlawful purpose under UAE law or the laws of your jurisdiction
• Resell or redistribute the Service or its outputs without our written authorization
• Use automated systems (bots, scrapers) to access the Service beyond normal use
• Reverse-engineer, decompile, or attempt to extract source code from the Service
• Use AI-enhanced images in a manner that is deliberately misleading or fraudulent

We reserve the right to suspend or terminate accounts that violate these policies without refund.

6. Intellectual Property

Your Content: You retain all ownership rights to the images you upload. By uploading images, you grant us a limited, non-exclusive, royalty-free license to store, process, and enhance them solely for the purpose of providing the Service to you. This license ends when the images are deleted.

Our Service: The PropertyPixel platform, including its design, software, features, and underlying AI technology, is owned by Web Ninja - FZCO and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

7. AI-Generated Results

Our Service uses artificial intelligence to enhance images. While we strive for high-quality results, AI-generated enhancements may not always be perfect. You acknowledge that:

• Results may vary based on image quality and content
• Enhanced images should be reviewed before use in listings or marketing
• We are not responsible for how enhanced images are used in property listings, marketing materials, or any other context
• It is your responsibility to ensure that AI-enhanced images comply with MLS guidelines and applicable advertising standards in your jurisdiction

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEB NINJA - FZCO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

10. Termination

We may suspend or terminate your account immediately, without prior notice, for conduct that violates these Terms, is harmful to other users, or is required by applicable law. Upon termination, your right to use the Service ceases immediately. Any unused subscription credits at the time of termination for breach are forfeited without refund.

You may delete your own account at any time from the Settings page. Upon account deletion, your data will be handled in accordance with our Privacy Policy.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates and the regulations of the Dubai Silicon Oasis Free Zone Authority, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

12. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email or by posting a prominent notice on the Service. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may cancel your subscription before the changes take effect.
